I, the undersigned, hereby acknowledge and agree to the following terms and conditions as a condition of participating in any activities or using any facilities or equipment at Short Game LLC (the "Facility"):**

Waiver Content

• Assumption of Risk:
  I understand that golf is a physical activity that involves inherent risks of injury, damage, or loss to persons, property, or equipment. I assume full responsibility for any such risks and waive any and all claims against Short Game LLC, its owners, employees, agents, or affiliates (the "Releasees") arising from or related to my participation or use of the Facility.

• Indemnification:
  I agree to indemnify, defend, and hold harmless the Releasees from any and all liabilities, damages, costs, or expenses (including attorney fees) resulting from any injury, damage, or loss caused by me or my equipment to any person, property, or equipment at the Facility, whether due to negligence, intoxication, or otherwise.

• Compliance:
  I agree to follow all rules, regulations, and instructions of Short Game LLC and the Releasees, and to use the facilities and equipment in a safe and proper manner. I understand that the Releasees reserve the right to refuse or terminate my participation or use of the Facility at any time for any reason, without refund or compensation.

• Fitness Certification:
  I certify that I am physically fit and have no medical condition that would prevent me from participating or using the services provided at Short Game LLC. I agree to inform the Releasees of any changes in my health or medical condition that may affect my ability or safety at Short Game LLC.

• Consent to Use of Likeness:
  I consent to the use of my name, image, likeness, or voice by the Releasees for any promotional or marketing purposes, without compensation or further notice.

• Acknowledgement of Legal Contract:
  I acknowledge that this waiver is a legal contract and that by signing it, I am giving up certain rights and remedies that I may otherwise have. I have read and understood this waiver, and I sign it voluntarily and of my own free will.

• Validity:
  I agree that this waiver is valid indefinitely and that it will apply to any future visits or use of Short Game LLC services unless I revoke it in writing.

Terms and Conditions: Memberships

1. Membership Pricing and Access:

   • The $79 Monthly Pass includes up to 1 hour of outdoor play daily on our Trackman Range plus unlimited short game chipping and putting on the outdoor greens. Additional time on the Trackman Range beyond the included hour is available at an extra charge.

   • The $129 Monthly Pass provides unlimited outdoor use on our Trackman Range all month long plus unlimited short game chipping and putting on the outdoor greens.

2. Membership Duration and Billing:

   • Memberships are billed monthly and are non-transferable.

   • Memberships renew automatically each month unless canceled before the renewal date.

3. Usage and Availability:

   • Outdoor Trackman Range access is subject to availability. Reservations are recommended to ensure your preferred time slot.

   • Indoor Trackman Simulator time is also subject to availability. 

   • Unused simulator time does not roll over to the next month.

   • Unlimited short game chipping and putting on the outdoor greens is included with all memberships.

4. Upgrades and Changes:

   • Members can upgrade their pass at any time, and the new rate will take effect immediately.

5. Cancellation Policy:

   • Memberships can be canceled at any time. Access remains active through the current billing cycle, and no refunds are issued for partial months.

6. Pass Sharing Policy:

   • If a pass is found to be shared, it will be revoked immediately, and the member will no longer be eligible to purchase another pass.

7. General Conditions:

   • Memberships are priced per person and are intended for individual use only.

   • Offers are subject to change or cancellation at Short Game’s discretion. Members will be notified in advance of any significant changes.
